B-85602068, and is registered with the Madrid Business Registry with the following references: Tomo 26,295, folio 63, hoja número m-473874, inscripción 1), hereinafter EXCELLENCE.
The purchase of tickets & packages using this website implies the acceptance of each and every of the clauses, terms and conditions contained in this legal notice as described below.
EXCELLENCE provides an online portal through which the service of locating tickets & travel packages to events that due to high demand are not readily available through normal channels, can be easily purchased in real-time. Tickets and packages offered are for all types of cultural and sporting events held both in Spain and abroad, specializing in those events of greater importance or social repercussion, which are therefore more difficult to obtain. Since you are buying for an individual service company, the prices stated on our website and that you pay, are generally much higher than the actual price printed on the ticket or actual value of the package created.
EXCELLENCE is a receptive travel agent for events world-wide who specializes in obtaining and creating ticket packages to such events that are very difficult to obtain or are sold-out. Contract shall be deemed to have been made between excellencetickets.com and the booking client (“the client”) when the client has confirmed requirements by, inter alias, facsimile, letter, written order form, or telephone and excellencetickets.com have accepted such a booking - an invoice / order confirmation being proof of such acceptance.
Purchasing packages from EXCELLENCE can be much different than buying from the Box Office so please read the below terms and conditions carefully before making a purchase as by visiting our website and making a purchase online or by phone, you are agreeing to our Terms & Conditions.
Credit Card Purchases
We accept Visa, MasterCard, Visa Electron, and American Express. Charges by our company on your card statement will ONLY appear as EXCELLENTS EVENTS TRAVEL. When purchasing using a credit card it is important to provide the actual address to which the card is registered to and where statements are sent. Failure to provide the correct Billing details may result in your order being cancelled at any time. Please note that purchases by credit card do not grant you any variances from our terms and conditions. You are still responsible for complying with our terms and conditions. Any attempts to defraud us will result in legal action brought against you.
EXCELLENCE accepts no responsibility for any possible damage or prejudices or unattained benefits by the User, which may have been produced as a consequence of the loss or extraction of the access code/ user name/ password to third parties and/or their use by a third party. Please keep these private details in a safe place at all times.
EXCELLENCE reserves the right to unilaterally modify at any time the system by which users can access the Website.
Cancellations / Refunds / Changes
Once an order has been successfully placed with EXCELLENCE the order is final and no cancellations or changes will be allowed. No refunds will be processed except in the case that an event is cancelled and not rescheduled. If an event is rescheduled the USER will not be entitled to any cancellation policy or refund. Please only order services and packages once you are certain you understand what you are being offered and that you want them as processed orders cannot be changed or cancelled. If an event has been cancelled and not rescheduled for a new date, you will be entitled to a full refund.
Order Processing
Once an order is placed and payment has been taken, you will be sent an email confirmation of your purchase. Many email providers have such strong SPAM filters that our email confirmations may be filtered out. Please do not assume that your order was not processed just because you did not receive email confirmation, at the end of online card processing you will be provided notification if the order was successful or not. Online orders placed outside business hours may not be processed until the following business day. With a phone booking you will be provided a booking reference number.
Prices
Payments will be taken in Euros unless otherwise stated. Please note that currency conversions may not be accurate and your bank may charge you international transaction fees. All prices stated on the website are inclusive of all local Taxes (IVA) and Fees. Prices are marked by the going market rate for tickets and packages and are subject to change at any time without notice.
Prices are guaranteed only once an order has been placed and payment processed successfully. We cannot guarantee the availability of offered services without an approved payment of those services and under no circumstance can they be reserved or held.
The seating charts on the site serve as a guide when purchasing tickets/packages and do not guarantee exact section and/or row locations unless otherwise stated. Tickets are packages are generally sold in general categories which are defined by the seller and can be described by our customer service representatives. We cannot be responsible for typographical errors within the product inventory listed on our website. If an error is found while processing your order we reserve the right to offer you a comparable alternative, if available, and you may reserve the right to cancel if not suitable.
We reserve the right to upgrade at any time without extra cost to client. An upgrade is considered any increase in face value of ticket/package provided. We also reserve the right to downgrade without notification and compensation will be paid according to the difference in the market value of tickets/services provided to that of the market value of tickets/services ordered at the original time of purchase.
Seating
All tickets purchased are not always guaranteed to be seated together. Seats are generally distributed in 2's, 3's and 4's and will be positioned as close to each wherever possible. If you require all seats to be together, please contact us for such a guarantee.
Event Dates & Times
Please be aware that events are subject to date & time changes. Events are generally confirmed 100% only 7-10 days prior to the actual event date and should be checked with the venue or promoter frequently. Checking this information will ensure that you attend the event on the correct date and at the correct time. EXCELLENCE will not always inform you of such changes and will not be responsible for your failure to check and make travel arrangements to accommodate the confirmed date/time.
Delivery
We guarantee the delivery of services before the event. Generally ticket packages are delivered 3-4 days before the actual event although this may vary by event. Since we are offering packages and services throughout the world, delivery methods may vary from country to country as well. Available delivery methods may be viewed during the purchase process and range from (Free of Charge for Collection to 50 euros for International FedEx/UPS/DHL shipments).
Due to the late release of tickets for many events, we reserve the right to deliver services, tickets and packages using methods that may vary from that selected at the time of purchase. You will be contacted to arrange a safe and secure delivery/collection of services or tickets packages.
International delivery is not always possible so if you are travelling to an event we suggest that you provide a local address to that of the event city/country. If this local address is a hotel, please be sure to provide all the required information so that the reception/concierges desk will recognize you as a registered client of the establishment. You may also want to notify the hotel that you will be expecting a delivery and request that they accept it on your behalf. We will not be held responsible if the hotel/recipient at the local address provided declines the delivery and it cannot be re-delivered in time for the event.
It is your responsibility to provide a safe and secure location for delivery and by providing a delivery address we assume that you authorize anybody at that address to act as your agent to accept for you. It is your entire responsibility to provide a complete and correct address for delivery, we cannot re-route packages once dispatched.
If you have not received delivery within 48hrs of the event or your departure, please contact us urgently within business hours sales@excellence-travel.com.
If you require that the order be delivered to an address different from the registered Billing Address of the card used for the purchase, we will require a faxed authorization from you. This authorization includes a signed copy of the invoice and legible copies of the cardholders ID/passport and the credit card that was used. We do this to combat against fraudulent use and all provided documents will be immediately destroyed after use. Failure to provide such documentation will result in cancellation of your order.
Lost / Stolen / Damaged Tickets
Please safeguard ticket packages as you would cash, as at no time can they be duplicated if lost, stolen or damaged. Please keep them in a safe place as replacements are not available.
Liability of Excellence
Due to the nature of our business and the fact that we cannot control the acts or omissions of third parties, we make no warranty, and specifically disclaim any liability, for any goods or services provided by third parties which are incidental to, ancillary to or consequent on your use of our services. Further, you agree to waive any liability against us for the actions, whether negligent or intentional, of any third parties, for whom you acknowledge we only act as agent for. We agree to act only as your agent and you agree to accept all liability associated with the payment, delivery cost or misuse of any services or goods provided as a result of your use of our services and you agree to indemnify us and hold us harmless against any and all damages, awards, penalties, or other liabilities of any nature whether the result of your intentional acts or omissions or negligence.
We may accept liability for any losses you suffer only up to a maximum amount of the value of the tickets. We will not be responsible for any indirect losses including consequential, exemplary, and special or punitive damages, including lost opportunities or loss of profits even if we have been advised of the possibility of such damages. In any event, we shall not be liable for death or personal injury suffered by the client or their guests arising out of their attendance at, or travels to any event. The limitations of liability shall also extend to any loss or damage sustained by property or belongings of the client or any guest or for further costs, damages or expenses incurred or suffered by the client arising out of the booking.
We will not be liable for any cancellation of or alteration to the booking or any loss or damage suffered by you arising out of circumstances beyond our control including but not limited to any act of God, natural disaster, or act of terrorism.
If an event is postponed the ticket package and services will be honoured for the rescheduled date and new tickets/vouchers will not need to be issued unless otherwise stated.
In case of nominative tickets, EXCELLENCE will not be responsible if access to the event is denied by the Promoter. Furthermore, if the Promoter reserves the right to decline admission or remove anyone from their grounds, EXCELLENCE will not be responsible beyond providing authentic entrances or passes.
Excellencetickets.com is a private travel agency, incorporated in Madrid, Spain and is not affiliated with Ticket Master, any box office, artist, sports team or venue. We are not affiliated nor endorsed by all of the artists, teams, venues or organizations listed on this site.
The Contract
These Booking Terms and Conditions shall constitute a binding agreement and contract between you or your company and Excellence Events Travel; you accept the terms and conditions of this contract when you confirm the requirements of your order in writing, in a booking form, email, purchase order, phone sale or facsimile.
This Agreement is governed by and construed in accordance with the laws of Spain. You agree, as we do, to submit to the non exclusive jurisdiction of the Spanish Courts.
